? What is the definition of adultery in Islam-

- What is the punishment for adultery in Islam?
1 - In the following cases the punishment is death :
A - Incest adultery (like sister or mother)(Article 82) (Rules of Islamic punishment) ( Islamic penance)
B - Adultery with stepmother when the adulterer will be killed. (Article 82) (Rules of Islamic punishment) ( Islamic penance)

2 - in the following cases the punishment is stoning :
A – Adultery with a married man (a man who has a permanent wife and while he was sober had sex with her and whenever he wants he can ) (Article 83) (Rules of Islamic punishment) ( Islamic penance)
B - Adultery of married women with a adult man (a woman who has a permanent husband and had intercourse with him when she was sober and has the possibility of doing it again), but punishment for adultery of married women with an under age man is lashes. 3- Punishment for adultery of a woman with a man - who has not a permanent wife- is a hundred lashes. (Article 88) (Rules of Islamic punishment) ( Islamic penance)
4- If a woman or a man commit adultery several times and after each time has been punished, the fourth time he or she will be killed. (Article 90) (Rules of Islamic punishment) ( Islamic penance)
5 - Adultery in times like Ramadan and religious holidays and the Friday and holy places like Mosque in addition to punishment(penance)has. (Article 106) (Rules of Islamic punishment) ( Islamic penance)
6 - Whenever the criminal has gone crazy or has apostatized, he will still be punished. (Article 95) (Rules of Islamic punishment) ( Islamic penance)
- How will the stoning be performed?
1- for stoning, the man is buried in the pit(ground) up to the waist and the woman is buried in the pit up near the breast. (Article 102) (Rules of Islamic punishment) ( Islamic penance)

2- If the adulterer -whose adultary is proven by testified witnesses - can escape the pit , he'll be returned to the pit , but if his crime is proven by his confession, he will not be returned to the pit and he'll be set free (Article 103) (Rules of Islamic punishment) ( Islamic penance)
3 - the stone used for stoning (stoned) should not be so big that kills the person after being hit by one or two , and also not so small that it wouldn't be called stone. (Article 104) (Rules of Islamic punishment) ( Islamic penance)
4 - It's appropriate that the judge inform people of the time of stoning and it's appropriate that some religious people(not less than three) attend the stoning execution. (Article 101) (Rules of Islamic punishment) ( Islamic penance)

In October 2001, a Muslim woman named Safiya was sentenced to death by stoning (rajm) by the Islamic Sharia Court at Sikota in North Nigeria. She got a reprieve because the Islamic Appeal Court ruled in March, 2002 that the act of adultery was committed before it was made an illegal act.
پاسخحذفIn August, 2002, a 30-year-old Muslim widow named Amina Lawal has been sentenced to Rajm by the Islamic Shariah Court at Bakori in State of Katsina, also in North Nigeria. Amina had an 8 month old daughter. The Appeal Court rejected her appeal but stayed the execution of the sentence till the end of the weaning period. Ahmadu Ibrahim and Fatima Usman convicted of adultery also stand sentenced to death by stoning. They are also awaiting the Order of the Appellate Court.
Already the sentences have evoked worldwide condemnation and protest. One can easily imagine world reaction as and when the sentences are carried out and receive worldwide publicity in the electronic media.
No doubt only a few Muslim countries have this law on their books, perhaps only Afghanistan, Iran, Nigeria and Saudi Arabia but the attitude of millions of people towards Islam perhaps forever will be determined by the sight and sound of the TV coverage and the printed words in the newspapers.
It, therefore, becomes the duty of all Muslims and specially the ulama (Religious Scholars) everywhere to examine whether Islam indeed prescribes this punishment for zina i.e. unlawful sexual intercourse between a man and a woman.
Islam stands for sexual purity and considers all sexual intercourse outside the marital bond as sinful. Thus it makes no distinction between adultery and formication or discriminates between the two situations: both parties are unmarried or one of the parties or both are married.
پاسخحذفThe Quran is the ultimate source of the Shariah because Allah has guaranteed its integrity. The Quran prescribes flogging. It does not even mention the word 'stoning' or 'death by stoning' (Rajm). Verse 24-2 says: "The woman and the man guilty of adultery or fornication flog each of them".
So how has this pre-Islamic punishment crept into Islam? Muslim jurists think that the Quranic punishment in Verse 24(2), applies only to fornication and that in the case of adultery, the Sunnah of the Prophet prescribes stoning to death.
